Emochi AI Terms of Service

1. Accepting these terms

By opening emochi.run, creating an account or sending a message to a companion, you accept these terms. If any part is unacceptable to you, please stop using Emochi AI.

2. Who may use Emochi AI

You must be at least 18 years old and legally able to enter a contract. You must also be in a place where adult companion services are lawful. Checking that is your responsibility, not ours.

3. What the service is

Emochi AI provides entertainment conversations with fictional companions, along with optional features such as voice notes, images and personality settings. It is a leisure product and nothing more.

4. Companions are fictional

Every companion on Emochi AI is invented. Names, biographies and portraits are created for the platform and do not represent, endorse or reproduce any real person, living or otherwise. No companion is a human being typing to you.

5. Creating an account

Registration requires accurate details and a working email address. Accounts opened with false information, or using another person’s identity, may be closed without notice.

6. Account security

Keep your password private and tell us promptly if you suspect unauthorised access. Activity carried out through your credentials is treated as yours until you report a problem.

7. One person per account

Accounts are personal. Sharing, selling, renting or transferring an Emochi AI account, or reselling access to it, is not permitted.

8. Acceptable use

Use Emochi AI for your own conversations. Do not scrape it, automate it, stress it, reverse engineer it, bypass limits, resell its output commercially or interfere with other people’s access.

9. Prohibited content

You may not submit or request material involving minors, real identifiable people in sexual contexts, non-consensual acts, violence, trafficking, illegal goods, self-harm instructions, hate speech or anything unlawful. Such requests are refused, logged and may be reported to authorities.

10. Your content

You keep ownership of what you write and upload. You grant Emochi AI a limited licence to store and process it so the service can function, continue your conversations and enforce these terms.

11. Generated replies

Companion replies are produced automatically and may be inaccurate, inconsistent or unintentionally odd. Treat them as fiction. Do not rely on them for facts about the real world.

12. Our intellectual property

The Emochi AI name, logo, interface, artwork, copy and companion characters belong to us or our licensors. You may not copy, republish or build a competing product from them.

13. Free access

Free use of Emochi AI comes with limits on message volume and certain features. Those limits can change, and free access can be withdrawn from accounts that abuse it.

14. Paid plans

Paid plans unlock higher limits and premium features. Prices, inclusions and billing periods are shown at checkout before payment is taken.

15. Renewals

Subscriptions renew automatically at the end of each billing period using your saved payment method, until you cancel.

16. Cancelling

Cancel at any time from your account settings. Cancellation stops the next charge; access continues to the end of the period you already paid for.

17. Refunds

Charges are generally final once a billing period has begun. Where local consumer law grants a withdrawal right, we honour it. Duplicate or clearly erroneous charges are refunded on request.

18. Price changes

If prices change, we give notice before your next renewal so you can cancel first. Existing periods already paid for are never repriced.

19. Taxes

Prices may exclude local taxes. Where we are required to collect VAT, GST or sales tax, it is added and shown at checkout.

20. Service availability

We aim for continuous availability but do not guarantee it. Maintenance, provider outages and events beyond our control can interrupt Emochi AI.

21. Changes to features

Features may be added, altered or retired as the product develops. If a change materially reduces what a paid plan offers, we will tell subscribers in advance.

22. No professional advice

Nothing said by a companion is medical, psychological, legal or financial advice. For decisions that matter, speak to a qualified professional.

23. Emotional wellbeing

Emochi AI is entertainment and not a substitute for human relationships or care. If you are in crisis, contact your local emergency number or a recognised support line, not a companion chat.

24. Third-party services

Payment, hosting and delivery partners have their own terms. Their failures are outside our control, though we will help resolve issues where we reasonably can.

25. Suspension and termination

We may suspend or close an account that breaks these terms, harms other users, threatens platform security or exposes us to legal risk. Serious breaches take effect immediately and without refund.

26. Disclaimer of warranties

Emochi AI is provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, accuracy or uninterrupted operation, to the extent the law allows.

27. Limitation of liability

To the maximum extent permitted, we are not liable for indirect, incidental or consequential loss, lost profits or lost data. Our total liability is limited to the amount you paid us in the twelve months before the claim.

28. Indemnity

You agree to cover our reasonable losses arising from your misuse of Emochi AI, your breach of these terms or your infringement of someone else’s rights.

29. Governing law and disputes

These terms are governed by the laws of the jurisdiction in which Emochi AI is established, without displacing consumer protections you enjoy at home. Please write to us first: most disputes end with an email.

30. Changes and contact

We may update these terms and will change the date above when we do. Continued use after an update means you accept the revised version. Questions go to hello@emochi.run.
